The IRS defines real estate in four ways:
- Property held for personal use (Personal Property)
- Property held primarily for sale (Dealer Property)
- Property held for productive use in a trade or business (Business Property)
- Property held for investment (Investment Property)
Business property and investment property qualify as 1031 property, as long as both the property sold and the property bought are of like-kind. What the buyer does with the property after you sell it does not affect its status as a 1031 property, as it relates to you. It is your use of the property that determines whether it is a 1031 property.
